1. Conclusion of contract
The contract between the customer and ULTRA MARINE is effective with the order of the customer and the acceptance of that one by ULTRA MARINE. The customer places an order by telephone, in writing form or via Internet. ULTRA MARINE accepts the order by (a) the passed ordering confirmation (by fax, E-mail or postal letter) or (b) by the delivery of the ordered goods (including the delivery sheet).
2. Order
The signed order by the customer is firm, an order done by Internet is firm by the invoice of the order. ULTRA MARINE is authorised to accept the contractual offer indicated in the order within three weeks by the invoice of an ordering confirmation. The delivery and the billing have value of a written confirmation.
3. Embroideries / textile printings
The ordered items in the on-line store can be embroidered or printed (as available). New motifs need an offer. Supplementary orders must contain an indication about the name of the embroidery or the print, or, if available, the reference number of the embroidery or the print.
4. Choice of products
All given indications referring to the products, which will be sent to the customer as part of the ordering process, are without any obligation. Modifications, as well as description errors, illustrations and price indications are of reserved right. All information regarding to various goods is based on manufacturer’s data and do only commit in this way.
5. Sending of samples
The sent samples must usually be billed. It is however possible to send a sample for a club or a company (for example, to give an idea about the size) if this would be necessary. The merchandise could then be returned (for embroidering or printing) or kept by the customer. The kept items are subject of billing with annexed payment bulletin.

6. Batch spreading / price reductions
Quantity spreading is partly indicated on Internet. Price reductions are however possible, partly from 10 pieces of the same item. More information is available on request. Daily actual prices will be passed at written request (for example via E-mail).
7. Delivery conditions
Invoice and packing fees are of only Fr. 9.- for all orders made on our Internet homepage. Should the delivery be done with several partial invoices, this fee will be charged only once. Delivery is inside Switzerland. The effective invoice charges, previously reported, will be billed for invoices outside Switzerland. The customer will be duly informed if there are delays for reasons attributable to the supplier.
8. Payment conditions
All catalogue prices are constantly adapted to the market. Small quantity orders of value less than Fr. 25.- will be increased by a fee of Fr.10.-. Usually, the payment must be done net within 30 days from billing date. New customers will only be able to buy against bank cheque or cash, or by prior payment of the bill before delivery. ULTRA MARINE keeps the right to deliver also existing customers by prior payment. The later option of credit card payment is not excluded, but not yet available.
Does the customer delay his payment, arrears interests will be billed and the charging for supplementary right is reserved.
9. Packing
Delivery will be done in regular used packages in the business; particular needed packages are of charge to the customer. ULTRA MARINE can, but must not, insure the goods at customers charge.
10. Sending
Sending is done by post or by truck, according to parcels quantity. Deliveries abroad are only done against previous payment. Cheques will only be accepted against payment (for sending abroad, for example). All necessary fees to cash will be billed.
11. Property rights
All the deliveries are done under property right reservation. The commercial business passes the property of one good to the customer only once all billed costs regarding to the commercial exchange are paid.
12. Warranty
Manufacturing faults of the delivered goods, that is also missing granted features, will be either repaired, or the good delivered again by our care as a new one. The customer has the right to demand a reduction for compensation (fall) or the cancellation of the contract (change) if the replacement or the reparation delivery would have failed.
Warranty allowance claims are possible if the customer does announce the obvious defects within two weeks, and the hidden defects within six months after delivery.
By demand, the customer has to present the defected good to ULTRA MARINE for evaluation. Does the customer refuse such expertise, he will then loose all allowances to every warranty.
13. Compensation
The commercial business is subject to replacement only for foreseeable damages, as long as those ones were caused by involuntary manner.
Data about embroideries and films are stored at ULTRA MARINE.
No liability is committed for recovering of data as long as these ones haven’t be destructed out of negligence or by planed manner.
